The Nevada legislator remains optimistic about restoring full tax deductions for gambling losses this year
Rep. Dina Titus of Nevada is championing a legislative push to protect professional gamblers and poker players from new tax burdens introduced under recent federal law. Her proposed legislation, known as the FAIR BET Act, seeks to reinstate the full one hundred percent tax deduction for gambling losses, reversing the current 10% cap that threatens the livelihoods of those in the industry. Despite the measure failing to pass in 2025, Rep. Titus insists that there is still a significant window of opportunity to correct the tax code before players are forced to file their 2026 returns under the restrictive new guidelines.
The urgency of this movement stems from a provision in the One Big Beautiful Bill Act, which effectively limits loss deductions to 90%. This shift has created an environment where professionals could potentially be taxed on income they did not actually net, fundamentally altering the economics of professional poker and sports betting.
Rep. Titus has emphasized that her office is utilizing every available legislative vehicle to move the bill forward. This includes attempts to attach it as an amendment to major spending packages like the National Defense Authorization Act and various appropriations bills.
While the FAIR BET Act has not yet reached the finish line, Rep. Titus highlights the bipartisan support the bill has garnered as a sign of its continued relevance. She describes the upcoming end-of-year legislative session as a prime opportunity, noting that year-end cleanup bills often serve as a vehicle for technical tax corrections.
By framing the issue as an active priority rather than a shelved project, Titus hopes to provide assurance to her constituents in Las Vegas and beyond. With the tax year still in progress, the congresswoman believes a late-season victory is possible, ensuring that the gaming community is not unfairly penalized by the current administration’s fiscal policy.
