House Bill 33 hopes to find enough support as gambling continues to expand in the US

A push for casino legalization in Kentucky is gaining traction, with Representative Thomas Huff introducing House Bill 33. The proposal outlines a plan to establish traditional land-based and riverboat casinos, managed by the Kentucky Horse Racing and Gaming Corporation. The bill also seeks to regulate the fantasy sports industry, aiming to expand the state’s gambling framework.

The plan includes a 21% tax on casino revenue, which is comparatively high but could generate significant funds for Kentucky. In addition, patrons would pay a $3 entry fee, potentially adding to operator revenues. Counties would have the option to decide whether to allow casinos through voter referendums or petitions, with eligibility depending on population.

Counties with fewer than 30,000 residents could still qualify by forming coalitions with neighboring areas to meet the population threshold. Areas with existing horse racing facilities would be automatically eligible to consider casino additions.

If a county approves casino construction, a competitive bidding process would follow. Licenses would start at $750,000 for land-based casinos and $550,000 for riverboat casinos, but bids are expected to climb as operators vie for approval. Existing facilities like Kentucky Downs may receive preferential treatment if they meet certain conditions, including outbidding competitors by 8%.

Kentucky, historically resistant to gambling expansion, has shown signs of change. The Bluegrass State launched sports betting in 2023, and historical horse racing machines, akin to slot machines, were legalized in 2021. With a state pension system funded at just 24.8% in 2024, additional revenue sources, such as casino taxes, could help bridge the gap.

HB33 also addresses fantasy sports, requiring operators to pay a $5,000 license fee and an annual fee or 6% of revenue, whichever is higher. Participants must be 18 or older, and college sports contests are prohibited.

Whether HB33 will pass remains uncertain, but the bill reflects growing interest in modernizing Kentucky’s gambling laws.
